Extension

Patents: If you apply for a patent based on an existing United Kingdom (UK) patent, within 3 years of UK date of issue, registration will normally be granted, the patent will expire with UK patent.

EP(UK): If you apply for a patent based on an existing EP(UK) patent, within 3 years of EP(UK) date of issue, registration will normally be granted, the patent will expire with EP(UK) patent.

Trade marks: Falkland Islands legislation introduced in 1996 allows for extension of UK right without re-registration - this then expires with the UK trade mark.

Designs: No provision for independent registration - UK designs registrations are automatically extended.

The Supreme Court of the Falkland Islands is empowered to declare that rights in a UK design have not been acquired in the Falkland Islands on any grounds for cancellation existing under UK law, including publication of the design in the Falkland Islands prior to the UK registration.
