Terms and Conditions of appointment for ordinary members

All appointments are made for a (renewable) period of 5 years.

Renewal

At the end of the 5-year appointment, renewal for one further period of 5 years is automatic subject to the individual's agreement and the upper age limit unless a question of cause for non-renewal is raised, or the individual no longer satisfies the conditions or qualifications for appointment. Renewals cannot give rise to more than a total term of appointment of 10 years and a person who has served as an ordinary member of the Copyright Tribunal is not eligible for appointment again.

Non-renewal

There are 8 grounds for non-renewal.

Removal

There are 6 grounds for removal from appointment.

Upper age limit

An appointment will not continue beyond the day on which a person attains the age of 70 years, but the Secretary of State, with the concurrence of the Chairman of the Copyright Tribunal, or if this person is by reason of illness, absence or other reasonable cause for the time being unable to perform the duties of his office, one or, if appointed, both of the Deputy Chairmen, may authorise continuance in office up to the day on which a person attains the age of 75 years if this brings the total number of years served to no more than 2 terms of 5 years.

Sitting days required

Due to the nature of the workload of this tribunal, no guarantee will be given on the number of sitting days that will be offered to post-holders. However, the allocation of work is a judicial function and, subject to overriding operational requirements, all post-holders will be offered work on the same basis.
