Enforcing your IP
You are responsible for enforcing your intellectual property (IP). If someone infringes your rights, that is they use them without your permission, you must decide what action to take, for example seeking injunctions and damages. In many cases, it is better and cheaper to try to negotiate a solution with the infringer before taking legal action.
If you have not registered your IP rights, you may be able to take action under common law of passing off .
You may wish to consult your legal adviser before taking action. Your patent or trade mark agent may be able to give advice.
