Council Regulation (EC) No 44/2001 ("the Brussels I Regulation")
On
21 April 2009 the European Commission published a Report
and Green
Paper
on the application of Council Regulation (EC) No 44/2001
on jurisdiction
and the recognition and enforcement of judgments in civil and commercial matters (“the
Brussels I Regulation”). It sought views from interested parties by 30 June 2009.
The UK Government is developing its own position ahead of EU negotiations to amend the Regulation. The Intellectual Property Office will be working closely with the Ministry of Justice to advise on those aspects of the Regulation that affect intellectual property matters. We would welcome the views of interested parties to help inform this advice.
In particular, interested parties may wish to consider Question 4 of the Green Paper, and the issues identified in Paragraph 3.4 of the Report.
