The artist's resale right: derogation for deceased artists

The consultation relates to the artist’s resale right which was introduced into the United Kingdom (UK) in 2006 when Directive 2001/84/EC1 ("the Directive") was implemented. Currently the UK uses a derogation in the Directive so the right only applies in the UK to works by living artists. This derogation will expire on 1 January 2010 unless the UK Government seeks a further two year extension in accordance with the terms of the Directive. This consultation relates to the UK Government's stated intention to seek an extension of the derogation for deceased artists from 2010 until 2012. It is not intended to cover any other aspects of artist's resale right.
The consultation is directed to all interested parties, including artists, art dealers and auctioneers and those who represent these interested parties.
