Reference of dispute to Comptroller

This is the first of four forms that relate to the Comptroller's jurisdiction with regard to unregistered design right.

You should complete this form if you wish to refer a dispute concerning design right to us. The fee is £65.00.

The dispute to be settled can be about:

  • Whether design right exists in the whole, or part, of an article.
  • When the design right came into force, and when it will expire.
  • The identity of the person who has the first claim to the design right.

You should note the following:

Two copies of a statement should accompany the form. The statement should include:

  • The name and address of the other party involved in the dispute.
  • The issues in dispute.
  • Your case.
  • Two copies of any documents referred to in your statement.

These provisions are set out in the Copyright Designs and Patents Act 1988. The rules governing these proceedings are The design right (Proceedings before Comptroller) Rules 1989.
