Appealing a patent decision

Decisions can be issued for both ex parte and inter partes patent disputes.

If one of the parties does not agree with the decision and wishes to take the matter further, then an appeal can be filed at the Patents Court, part of the High Court.

Three copies of a Notice of Appeal must be sent to the High Court Appeal Office together with a fee of GBP £200 within the time period set out in the decision. This will usually be 28 days. If more time is required to file the appeal, you need to contact the court to request an extension of time.
