Opposing an application to amend a patent specification

Section 75 before the court

To oppose an amendment filed under section 75 before the court, a notice of opposition must be filed at the court. In the notice, reasons for opposing the amendment must be clearly set out. A copy of the notice must be sent to us, and also to anyone involved in the court proceedings. This must be done within 14 days of the advertisement on our website of the application to amend.

Section 75 before the comptroller and section 27 amendments

To oppose an amendment filed under section 75 before the comptroller or an amendment filed under section 27, the following must be completed and sent to us:

  • 2 copies of form 15 PDF document(18Kb) along with the fee of GBP £50. A further fee of GBP £350 will need to be paid later.
  • 2 copies of a statement setting out fully the facts of the case and what you want us to do

An opposition to an amendment under section 75 before the comptroller must be filed within 2 weeks of the advertisement on our website of the application to amend.

An opposition to an amendment filed under section 27 needs to be filed within 4 weeks of the advertisement on our website of the application to amend.
