Summary

The decision concerns the issue of whether the invention claimed has an inventive step and is not obvious. The claimed invention relates to the combination of a pair of foldable shoes and their carrier, the carrier having a main compartment for the foldable shoes, a second compartment containing a collapsible bag having a carrying capacity greater than the main compartment and an attachment means for connecting the collapsible bag to the carrier or another bag.

The hearing officer found the claimed combination to be a collocation of known features each independently performing its proper function such that there was no synergy between them. The Windsurfing /Pozzoli test was also applied and he concluded that the claims were not inventive over the cited prior art.
