Hearings on ex parte matters involving Counsel

When a request for an ex parte Counsel hearing is received and a Counsel has been nominated, the Registrar will notify the Counsel’s clerk of the time and date on which the matter will be heard. The Registrar expects to give three months advance notice of hearing dates. Once set the date of the hearing will only be changed if an alternative date is provided which is convenient to the Registrar and is within a timescale which is satisfactory to the Registrar.

Where a particular Counsel has not been nominated, the Registry will set a hearing date and it will be the responsibility of the agent to find a Counsel who is available on the date in question.
