Requests for statement of grounds of decisions of the Registrar

This notice is to remind practitioners that in accordance with Rule 62(2) of the Trade Marks Rules 2000, any party may within one month of the date on which the notice was sent to him, request the Registrar on Form TM5 (114Kb) (and necessary fee) to send him a statement of the reasons for the decision.

There have been a number of instances recently where the Form TM5 has been filed outside the period set down in Rule 62(2) and has resulted in retrospective extensions of time being sought.

You are reminded that this one month period may be extended by a request on Form TM9 provided the reasons put forward justify the extension sought. In the case of Inter Partes proceedings, you must ensure that any request is copied to the other party to the proceedings.
