Request to receive notification of conflicting later filed marks (opt-in)
The form TM6 allows the owner (or their representative) of Community Trade Marks and International Trade Marks designating (covering) the European Community to opt-in to receive notification of any later filed conflicting trade mark applications. The form is available on our website for electronic completion. There is a fee of £50 per mark valid for a period of 3 years.
You should be aware that the Department has publicly consulted about a change in the law in this area and is currently considering the responses received. It is possible that the law might be changed and, if this happens after the owner of an EU trade mark has opted-in, it is possible that it may not receive notifications for the full three year term set out in the current legislation.
Owners or their Representatives of UK filed trade marks and International trade marks designating (covering) the UK, will be notified of any later filed conflicting marks. If you do not wish to be notified of any later filed conflicting marks you should write to us requesting to OPT-OUT of the notification system.
