Restoration

If you registered your design on or after 1 August 1989 and you do not renew it in the 6 months after the renewal date, you have a further 6 months, to apply to restore your registration.

You cannot restore designs registered before 1 August 1989 that have not been renewed within the 6 months allowed.

Fill in Form DF29

To restore a registered design, fill in form DF29 and send us

  • a statement of the reasons for your failure to renew, and
  • a fee of GBP £120

What happens next?

We will process your application to consider restoration of registered designs and give notice of the application in the Patents & Designs Journal (PDJ).

If we are satisfied that failure to pay the renewal fee was unintentional, we will write to tell you and ask you to send us:

  • Form DF9A - Application to extent the period of protection and
  • The correct renewal fee

Once we receive your forms and fees, we will restore your design to the register and publish that fact in the PDJ .

If we are not satisfied with your reasons for failure to renew, we will:

  • write and explain why we have not accepted them; and
  • allow you 2 months to request a hearing.

If you do not request a hearing within 2 months, we will refuse your application and publish that fact in the PDJ .
