Counter statements

If someone has filed proceedings against you, or we believe you may have an interest in the case, we will tell you and send you a copy of any papers we have received. This includes a statement of grounds, giving details of the case.

If you do not agree with the statement of grounds, you must file a counter statement, to tell us:

  • which allegations you do not agree with and why. You should also tell us your version of events
  • which allegations you do not agree or disagree with but would like the other side to prove
  • which of the allegations you accept are true
  • it would also be useful to give us an idea of whether you want costs awarded to you.

We will assume that you agree with the allegations, unless you specifically say otherwise.

Statement of truth

You must confirm the accuracy and truth of all the information contained in the counter statement by adding the following declaration of truth at the end:

'I confirm that the information contained in this counter statement is true to the best of my knowledge and belief’

If the counter statement is found to be incorrect or untrue and you do not have a good explanation why, we may consider this when making the final decision or an award of costs.

What happens next?

We will send a copy of your counter statement to the person who started the proceedings. To continue the proceedings to the next stage, he will need to file a form 4 and pay a fee of GBP £350. We will then review the documents filed and will consider the best way of proceeding with the case.
