Workstream 1: Practical Guidance on IP to facilitate cross-border collaborations

The objective of work stream 1 was to produce a set of practical guidelines relating to the ownership of IP to facilitate and promote cross-border collaborations (see 1st work stream of the CREST OMC-3% IP-Expert Group PDF document(21Kb) for full details).

The results of their analysis is based upon three elements:

1. National fact sheets that aim to cover every member state, including those not represented in the expert group and trading partners.

2. An analysis of the issues covered in the fact sheets is reported in Part 3.2 of the report. It looks at the different IP regimes within Europe and gives examples of how issues are dealt with on a national level.

The topics covered are:

  • Types of IPRs
  • IP Ownership
  • Negotiations of IPR contracts
  • Effect of funding on IPR contracts
  • Confidentiality and publication
  • Examples of IPR contracts
  • Protection and Enforcement of IPRs

The group provide their advice on dealing with each of these concerns. The group has made a number of recommendations for member states both individually and Europe wide. Their main conclusions are available..

3. A Toolkit to assist companies and public-funded research organisations (PROs) that wish to collaborate on research projects across international borders. The toolkit is aimed at representatives from PROs and/or companies familiar with IP and the requirements of research funding, who have identified a research and/or development project that needs to be undertaken. Definitions of the terms used in the decision guide are provided.
