Workstream 1: Main Conclusions

The main conclusions drawn from the analysis were:

  • The ownership of IPR is a key issue during collaborative R&D negotiations. All parties should ensure that resultant IP is protected adequately and mechanisms to assign or license the results are clear
  • On negotiating IPR contracts parties must be aware of differences in the systems of partner countries.
  • Partners should be aware of the restrictions imposed by public funding on the ownership of IPR.
  • PROs and their industry partners should identify and discuss from the outset their conflicting needs as regards publication of the research results
  • IPR contracts should include a clause outlining whether the PRO will assist in the enforcement of the resultant IPR.

In summary, the Group recommended that cross-border collaborations should be promoted as a viable option for industry and PROs. Member states should therefore provide practical resources and assistance to IP related issues. Wide dissemination of the CREST report, in particular its toolkit and guidance, should overcome any misunderstanding on confidentiality and the perceived complexities of different IP regimes.
