Summary
In her interim decision (BL O/316/15), the Hearing Officer refused the application for lack of inventive step. However, she found that the invention defined by the second set of amended claims proposed at the hearing met the requirements of section 1(1)(b) and gave the applicant one month from the date of the decision to formally file these amendments. She also noted that the applicant would need to file a further Form 52 and fee to request a discretionary extension of two months if he wished to submit amendments. The amendments were filed within the extended compliance period and put the case in order for grant.
