Summary
The registered proprietor filed evidence of use but admitted that the mark as registered had not in fact been used. Generally use was of the words Tripp Trapp and there had been some use of the words TRIPP TRAPP and a somewhat similar device depicting the specialised chairs sold by the proprietor.
The Hearing Officer considered the matter carefully but concluded that the use by the registered proprietor had been of a mark which possessed a distinctive character different from that of the mark registered. The application for revocation thus succeeded.
