Summary

The opponents opposition was based on a claim that devices of globes were non-distinctive in Saudi Arabia and that the surname Ajlan was also common in that Country. The applicants admitted that they sold goods in Saudi Arabia and the Middle East but that the objections did not apply to an application for registration of the mark at issue in the UK.

The Hearing Officer considered that the claims put forward by the opponents and their evidence relating to such claims was not relevant in relation to an application to register the mark at issue in the UK. The Hearing Officer concluded therefore that the opponents failed in all their grounds of opposition to the mark at issue here.
