The Applicant disclaims any exclusive right to the word "ZERO" separately and apart from the figurative mark as shown. Whilst the Applicant acknowledges that the word "ZERO" may allude to a characteristic of certain goods, the present application is for the composite figurative mark as filed and not for the word alone. The Applicant respectfully submits that the mark incorporates significant stylisation and distinctive graphical elements which create an overall commercial impression extending beyond a mere representation of the word "ZERO" in ordinary lettering. The mark consists of a unique arrangement and stylisation of the letters, together with distinctive visual features and design elements, which are capable of functioning as a badge of origin. The relevant consumer will perceive the mark as a distinctive figurative logo identifying the commercial origin of the Applicant's goods, rather than merely as a descriptive indication of their characteristics. The overall combination of graphic elements, stylisation and presentation creates a distinctive character when the mark is considered as a whole. Accordingly, whilst no exclusive rights are claimed in the word "ZERO" standing alone, the Applicant submits that the figurative mark as filed possesses the requisite distinctive character for registration and is capable of distinguishing the Applicant's goods from those of other traders.
