Summary

This search was subsequently completed after grant and identified two citations that were considered by the Examiner to anticipate claim 1. The proprietor was consequently invited to make amendments. None were forthcoming and the proprietor, now representing themselves, requested a hearing to avoid revocation under Section 73(1). The hearing officer found claim 1 to be anticipated but agreed with the applicant that there were saving amendments. In doing so they gave the proprietor three months to make the required amendments or they would revoke the patent under Section 73(1).
