Summary

The applications relate to adjusting an exercise regimen and calculating a sleep need for a user respectively both based on heart rate data considering a menstrual cycle of the user. The Hearing Officer applied the four step Aerotel approach and the AT&T signposts as modified in HTC. The application relating to adjusting an exercise regimen was found to relate solely to a program for a computer and a method for doing business as such, so did not meet the requirements of section 1(2)(c). The application relating to calculating an amount of sleep for a user was found to be a program for a computer as such, so did not meet the requirements of section 1(2)(c). Amendment may be possible for both applications, so the agent was invited to submit amendments otherwise the applications will be refused under Section 18(3).
