Summary

The Hearing Officer followed the approach in Eli Lilly v Human Genome Sciences and considered the teachings laid out in Zipher Ltd v Markem Systems and Kirin-Amgen Inc v Hoescht Marion Roussel. He decided that it was not possible for the skilled person to make the claimed invention without an undue burden of research. The application was thus not sufficient and was refused under section 18(3).
