Summary

A request to amend a patent was opposed. The proprietor of the patent did not file a counterstatement contesting the opposition to the amendments. The practice in an earlier office decision Rita Rusk was followed and the merits of the opposition were considered with the proprietor being treated as supporting the opponent’s case. The proposed amendments to the claimed invention, which related to an earthing nut, were not considered to provide the necessary inventive step over the prior art. The request to amend was therefore refused.
