Summary

The claimant’s case was that they were entitled to the patent by virtue of the inventors’ employment by the claimant at the time of the devising of the invention of the patent. They also submitted that both proprietors of the patent were aware at the time of grant that they were not entitled to the invention and it was therefore possible to make an order under section 37 despite the time that had elapsed since the grant of the patent. The proceedings were unopposed, and the proprietors of the patent were therefore treated as supporting the claimant’s case. Taking this into account, and after considering the evidence, the hearing officer found that the claimant was entitled to the patent and that an order could be made transferring the patent to the claimant, notwithstanding the time that had elapsed since the grant of the patent. He therefore made such an order.
