Summary
The application concerns a hygiene composition, in particular a natural personal care product such as an antiperspirant or a cleaning lotion, dispensable using an apparatus (e.g. a rollerball). The application is directed at overcoming various perceived disadvantages in prior art compositions by having a hygiene composition formed by combining and mixing a solute with water in the rollerball itself. An impasse had been reached on the issues of whether the claims comprised an inventive step and whether the latest claims on file contained added subject matter. The hearing officer considered the obviousness of the product, applying the Windsurfing/Pozzoli test. The hearing officer concluded that the lacked an inventive step over the prior art and common general knowledge. The hearing officer also concluded that the latest amended claims and all auxiliary request claims contained added subject matter. Having reviewed the application, the hearing officer could find no saving amendment. The application was refused.
