Summary
This decision relates to whether a procedural error caused GB2588834 to be revoked and whether the provisions of section 73(1C) and/or rule 107 can be used to cancel the revocation and bring the patent back into force.
The Hearing Officer found that the correspondence relating to the section 73(1A) action was issued to the attorney in line with the Office’s well-established procedures. The fact the attorney failed to receive these communications via e-mail and post was not the fault of the Office, therefore rule 107 could not be used in this instance. The patent therefore remains revoked.
