Summary
The claimants applied for revocation of the patent GB2266111, and the defendant, as patentee, opposed the application. Following negotiations, an agreement was reached whereby the application for revocation was withdrawn, and the patentee offered to surrender the patent. The Hearing Officer nevertheless considered on public interest grounds whether to accept the offer of surrender or to order revocation. Following further submissions, the Hearing Officer concluded that on the balance of probabilities a case for revocation had not been made out, and so accepted the offer to surrender.
