Summary

The invention relates to an oyster safety knife with a cambered blade rising from a flat rounded tip to a higher elevation at hilt with side scrolls to prevent the blade sliding through the oyster and puncturing the hand holding it. Replacement drawings and new claim were filed in which the blade of the knife is conical, the side scrolls are embossed and the flat rounded tip omitted.

The Hearing Officer applied the test in Bonzel and Schneider (Europe) AG v Intervention Ltd as summarised in Richardson-Vicks Inc.’s Patent and found that the amendments add matter. The application was refused.
