Summary

A request was made for reinstatement of GB2108001.5. The request was filed out of time and the attorney argued that either r.107 or r.111 ought to allow the extension of the compliance period. It was alleged the examiner had erred in deciding whether to apply comptroller’s discretion to accept a late response. Also, that three letters sent by the office had never been received in their office.

The HO found that comptroller’s discretion had been applied correctly. She also found that although a communication failure may have been a contributory factor in the failure to put this application in order in time, it was not the whole or the main reason. She found a significant contributory factor to be the attorney’s lack of action when made aware of key deadlines by his administrative system. As such the r.111 ground did not succeed.
