Summary

The defendant failed to file a counter-statement by the deadline set by the Office. Following receipt of a subsequent letter sent by the Office, they requested an extension of time of two months and sixteen days for filing the counter-statement on the basis that they were not aware of the claim until they received the later letter from the Office. A counter-statement was filed with the request, and reasons for why the extension was needed were provided. The claimant opposed the request. The hearing officer found the decision to be finely balanced but decided that justice was best served by allowing the request.
