Summary

The claimant submitted that they were the sole inventor in the patent applications in dispute and were solely entitled to the applications. The defendant filed a counter-statement but then, following the filing of the claimant’s evidence in chief, withdrew from the proceedings. The hearing officer decided the matter based on the papers on file, taking into account that the defendant had filed no substantive evidence as part of the evidence rounds. He decided that the claimant was the sole inventor of the inventive concept in the patent applications, and, in the absence of any agreement of employment or other contractual arrangement, was therefore solely entitled to the applications.
