In deciding the benefit of the doubt should be given to the applicant, the hearing officer concluded sufficient information is present for the skilled addressee to perform the invention. The hearing officer decided the prior art presented did not demonstrate the invention was obvious. As the statutory requirement for searching of the prior art was not completed, the hearing officer arranged for a search to be performed and the results to be communicated to the applicant. The hearing officer decided the claimed invention was sufficiently clear, novel and not obvious.
