Summary

Mr Zacharias claimed that he was the inventor together with a Mr Fowls of a tool for applying soldering flux to pipes rather than the currently named inventors Mr Knox and Mr Davies. Further Mr Zacharias claimed to be entitled to the patent instead of the currently named proprietor Dazcom Limited. Mr Zacharias had established Dazcom with Mr Fowls to commercialise the tool however he had subsequently fallen out with the other shareholders. Mr Knox and Mr Davies are employees of a design company employed by Mr Zacharias and then Dazcom to turn the initial idea of Mr Fowls into a viable product. It was found that the invention in the granted patent related to the work undertaken by Mr Knox and Mr Davies and that they were therefore the actual devisors of the claimed invention. It was found that they had legitimately assigned their rights in the patent to Dazcom by virtue of assignments signed also by Mr Zacharias on behalf of Dazcom
