Summary
The application relates to methods and systems for evaluating signal propagation delays in an avionic system.
The applicant filed amended claims prior to the hearing which overcame an added subject matter objection under section 76(2) which was accepted by the hearing officer.
The examiner had raised an inventive step objection based on three citations. Applying the approach set out in Windsurfing and Pozzoli the hearing officer found that the differences between the inventive concept of the system defined in the independent claims and the prior art would not be obvious to the skilled person and allowed the application as having an inventive step required by section 1(1)(b). The application was remitted back to the examiner, for amendment by the applicant of the description in line with the claims as settled.
