Summary

The application relates to a magnetic motion device, which is presented in the specification as a device which produces an “imbalanced force” using a “pent up” force which is produced when one magnetic mass is moved into the repelling magnetic field of another magnetic mass. The description states that this could be used to produce motion, and the only suggested use of the invention is for “space propulsion”. At the hearing the applicant demonstrated a prototype of his invention, showing how a motor is used to begin and maintain motion of the magnetic masses within the device.

Several objections were maintained through rounds of examination including clarity and industrial application, and the hearing officer subsequently found in her decision the claims to be lacking in clarity and the invention not to be capable of industrial application.

It was clear from viewing the prototype at the hearing that essential features of the invention were not present in the application as originally filed. The application was refused.
