Summary
The patent applications were filed in the name of MG Electric (Colchester) Limited (“MGE”). They named Hassan Shirvani, a professor at Anglia Ruskin University (“ARU”), and Vahaj Mohaghegh, an employee of MGE from September 2021 and, before that, a PhD student at ARU. The claimant, a consultant vascular surgeon, asserted that he devised the inventive concept in the patent applications and was therefore entitled to the applications. A two-day hearing took place at which the claimant, both inventors and the Technical Director of the defendant were cross-examined. I considered all the oral and written evidence and, noting that the onus is on the claimant to prove their case on the balance of probabilities, decided that they had not done so, and that MGE are entitled to the applications.
