Summary

This was a costs decision following a revocation action. The defendant had submitted unconditional amendments when filing the counterstatement, and ultimately the hearing officer had upheld these amended claims.

The hearing officer awarded costs on the scale to the claimant for proceedings up to the filing of the counterstatement, and to the defendant thereafter. He declined to make an award of costs off the scale, despite the unacceptably late nature of the presentation of the claimants arguments, because in the event the lateness did not appear to have significantly have increased the defendants costs.
