Summary
Second preliminary decision
Although minded to withdraw existing confidentiality directions on parts of the defendants evidence, for which they said they were under obligations of confidentiality to a third party, the hearing officer gave the defendants a period of 7 days to comment before making any further order. The hearing officer proposed to take no action in respect of the defendants allegation that the claimants had breached the existing directions.
The claimants had originally requested confidentiality for the whole of their evidence in reply, but, following correspondence and with the agreement of the parties, the hearing officer directed confidentiality for a very small part only of the evidence. The hearing officer also gave a period of 7 days for comments before laying another part open to public inspection, some at least of which already appeared to be in the public domain.
